Seminar “Sources of International Law: Nuclear Weapons advisory opinion as an example” by Professor Sienho Yee

On the morning of November 8, Professor Sienho Yee, the Chief Expert of Wuhan University China Institute of Boundary and Ocean Studies (CIBOS), held the seminar “Sources of International Law: Nuclear Weapons advisory opinion as an example”. This seminar focused on the International Court of Justice (ICJ) advisory opinion on the Legality of the Threat or Use of Nuclear Weapons [1996], and gave in-depth analysis on how ICJ will apply international law when dealing with relevant cases.

Professor Sienho Yee cited Article 38 of the Statute of the ICJ to introduce the sources of international law. He commented that in common, Article 38 was deemed as the sources of international law, however, it in fact provided how the ICJ should apply relevant international law when handling cases. In 1996, per the request of the United Nations General Assembly, ICJ gave its advisory opinion on the Legality of the Threat or Use of Nuclear Weapons. Professor Yee vividly explained the application of Article 38 of the Statute of the ICJ in this case, and emphasized that the process demonstrated the rigorous thinking of ICJ when applying the Statute.
